Summary
In Episode 2 of Sheridan Consult's AGNI Explained series, Hannah Qaisir, Business Development Manager, moves from what changed under AGNI to how reviewing teams actually apply it, setting out the three questions every team should be asking when working through a real case. If you haven't watched Episode 1 yet, it's worth starting there first.
Question one: what is the person's actual situation? This returns to the four factors set out in Episode 1, now applied directly to the facts of a case: the type of restriction in place, how it's implemented, its duration, and its effect on the person. As the video sets out, these four factors build on each other, restriction leads to how it's carried out, which leads to how long it runs, which leads to what it actually does to the person.
Question two: what are the person's wishes and feelings telling us? This covers acceptance and objection, but also behaviour and communication, the things a person shows as well as what they say. The episode is explicit that none of this should be automatically assumed either way: acceptance can't be read from silence, and objection can't be assumed just because a person lacks capacity for the decision.
Question three: does this amount to a deprivation of liberty? This brings the first two questions together. When everything is considered as a whole, does the situation amount to a deprivation of liberty? Critically, no single factor decides the outcome on its own, which is exactly why the first two questions carry equal weight rather than one overriding the other.
